The Montgomery County Sheriff’s Office says that Thomas Dillard Jr., 39, was shot and killed early Wednesday morning after he allegedly broke into A&P Collision, located at 12952 Highway 105 East in Conroe.

The business owner reportedly told investigators he was asleep inside the business when he awoke to glass breaking outside at 2:28 Wednesday morning.

“The business owner stated he has reported numerous burglaries in recent weeks, so he took his handgun and went to investigate,” said Sheriff’s Deputy Steve Squier. “When the business owner exited the front of his business, he observed an individual wearing dark colored clothing near a Conex box.”

Squier said the business owner yelled at Dillard, and the suspect ran toward the owner. The business owner said he was in fear and discharged his handgun several times at Dillard as he ran west from the collision center.

Deputies later found Dillard lying in a ditch near the driveway of a nearby business. The Montgomery County Hospital District responded to the scene, but Dillard died from his injuries.

Montgomery County Crime Scene Investigators, detectives from the Homicide Violent Crimes Unit and the Montgomery County District Attorney’s Office responded to the scene. The business owner is cooperating with investigators, and the evidence reportedly supported the statement he provided, authorities say. The case will be forwarded to a Montgomery County Grand Jury for review once completed.
